Delivery Policy

How and when we deliver what you have engaged us for — online and, where agreed, offline — plus acceptance, installation and what happens if something is delayed.

1. Scope

This Delivery Policy applies to the delivery of services, software and digital products supplied by Atomos Technologies (OPC) Private Limited. It should be read with our Terms & Conditions and Refund Policy.

We supply digital services and work product. We do not sell physical consumer goods, and no physical shipping is involved except in the limited offline delivery case described below.

2. Ordering

Services may be ordered by executing a Services Agreement, statement of work or purchase order, or where offered, by placing an order through the Website. Where an order is placed on the Website, you provide the personal and billing details required to process it, and payment may be made through the available payment methods or offline as agreed.

An order is accepted only when we confirm it in writing. We may decline an order at our discretion, including where the requested work falls outside our capability, conflicts with our obligations to another client, or raises legal, ethical or security concerns.

3. Delivery methods

Online delivery (default). Services and digital products are delivered electronically. Depending on what has been agreed, this may be by:

  • Commit to a source repository you control
  • Deployment to infrastructure you control or that we operate for you
  • A secure download link, expiring after a stated period
  • Email delivery of documents and reports
  • Access credentials to a hosted environment

Offline delivery (by arrangement). Where you require delivery on physical media, this can be arranged at additional cost, agreed in advance. Physical media is supplied by you or procured at your expense, arrangements are made in consultation with you, and risk passes on handover to your nominated carrier or representative.

4. Delivery timeframes

  • Timeframes for each deliverable are set out in the Services Agreement and confirmed on order acceptance.
  • Documents and reports — typically delivered on the date agreed in the engagement schedule.
  • Software releases — delivered per the agreed milestone or sprint schedule.
  • Offline delivery — depends on your location and the shipping method selected, and is quoted separately.

Timeframes assume your timely cooperation as set out in our Terms & Conditions. Where a delay is caused by matters within your control, or by a third party outside our reasonable control, timeframes adjust accordingly and we will notify you in writing.

5. Acceptance

Unless the Services Agreement provides otherwise, you have 10 working days from delivery to review a deliverable against its agreed specification and to notify us in writing of any material non-conformity. If we receive no such notice within that period, the deliverable is deemed accepted.

Where you notify a material non-conformity, we will correct it and re-deliver, and the acceptance period restarts for the corrected deliverable.

6. Installation and configuration

Whether installation, configuration, migration or environment setup is included is specified in the Services Agreement. Where it is not included, it can be provided as additional work, quoted and agreed in writing in advance.

Where installation takes place in your environment, you are responsible for providing timely access, credentials and any third-party licences required.

7. Your responsibilities

  • Provide accurate and complete delivery details, including the correct email addresses and repository or infrastructure access
  • Ensure a nominated contact is available to receive and acknowledge delivery
  • For offline delivery, provide a suitable delivery address and an available contact person
  • Maintain your own backups of delivered materials once delivery is complete

8. Confirmation of delivery

For online delivery, confirmation is provided by email or other electronic means, and the repository commit, deployment record or download log serves as the delivery record. For offline delivery, a signed confirmation of receipt is obtained on handover.

9. Delays and failed delivery

We will notify you promptly of any delay affecting an agreed date, with a revised date and the reason. Where delivery fails because of incorrect details you supplied, or because a nominated contact was unavailable, re-delivery may incur additional cost.

Where we fail to deliver a contracted deliverable and cannot remedy that failure within a reasonable period after written notice, the Refund Policy applies.

10. Support after delivery

Post-delivery support is governed by the warranty terms in our Terms & Conditions and by any support or maintenance engagement you have entered into. For questions about delivery, contact care@atomostechnologies.com.

11. Changes to this policy

We may update this policy at any time. The version in force at the time you place an order governs that order. The current version is always published here with its effective date.
